PIRS Capital (“PIRS,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, retain, and protect Personal Information we obtain when you visit our website, apply for a loan, become a borrower or guarantor, or otherwise interact with us. It also describes the rights and choices available to individuals whose Personal Information we process. The Privacy Policy supplements, and does not replace, any notices or disclosures provided in our loan agreements, disclosures required by applicable law, or additional terms governing specific products or services.

This Privacy Policy applies to Personal Information collected through pirscapital.com (“Site”), through our loan application and servicing processes, and through our communications with applicants, borrowers, guarantors, and authorized representatives. If you do not agree with this Privacy Policy, please do not use the Site or submit Personal Information to us.

Although our products are commercial loans made to business entities, we recognize that certain applicants and guarantors are sole proprietors, owners of pass-through entities (including S corporations), or other individuals whose information is protected by state privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

Please review this Privacy Policy carefully to understand what we do in regards to your Personal Information.   • Funding sources, Assignees, Syndicate Partners, and Potential Purchasersin connection with funding, participation, syndication, securitization, or sale of loans, and related due-diligence processes.
  • Referral Partners and Brokerswhere they are involved in originating or servicing your loan and subject to appropriate confidentiality obligations.
  • Professional Advisorsincluding our attorneys, auditors, and insurers.
  • Legal/Regulatory Authoritiesincluding to respond to a subpoena or court order, judicial process, or regulatory inquiry; to defend against fraud, lawsuits, claims or other liabilities; and to prevent physical harm or financial loss in connection with any suspected or actual illegal activity.
  • Purchasers of Business or Assetsshould we undergo any change in control, including by means of a merger, acquisition, or purchase of substantially all of our assets, your Personal Information may be shared with the parties involved in such transaction.

How We Use Personal Information

  • To comply with applicable laws, regulations, legal process, and regulatory inquiries, including under federal and state banking, consumer-financial-protection, anti-money-laundering, and tax laws.

  • To send marketing communications about PIRS products and services (subject to your opt-out rights described below).

We are based in the U.S. When you provide personal data to us from outside of the U.S., please be aware that we will receive and process it in the U.S. and may transfer and maintain your personal information across borders to any of the places where we and our vendors and partners do business, which may be outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those of your country of residence. By accessing or using our Site and services, you agree that all information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States, which may have data protection laws that are different from (and, in some cases, less protective) than the laws where you reside.

Please note, we do not “sell” or “share” (as those terms are defined under the CCPA) your Personal Information. Our Use and Disclosure of Sensitive Personal Information

Under the CCPA, certain Personal Information we collect and process may be considered “Sensitive Personal Information” (e.g., passport number, driver's license, state identification card, and citizenship and immigration status). The CCPA requires that we provide you with a right to limit our use or disclosure of such Sensitive Personal Information in certain circumstances. Currently, we are not using your Sensitive Personal Information for purposes that would require that we provide you with a right to limit.

Your Rights

If your Personal Information is subject to the CCPA, you may have certain rights, subject to applicable exemptions and limitations, with regard to such Personal Information, including the right to:

  • Be informed, at or before the point of collection, of the categories of Personal Information to be collected and the purposes for which the categories of Personal Information shall be used.
  • Request that we delete any Personal Information about you that we collected, subject to certain exceptions (“Request to Delete”).
  • Correct inaccurate Personal Information (“Request to Correct”).
  • Request that we, as a business that collects Personal Information about you and that discloses your Personal Information for a business purpose, disclose to you (“Request to Know”) the: (i) categories of Personal Information we have collected about you; (ii) categories of sources from which we collected the Personal Information; (ii)business or commercial purpose for collecting or selling the Personal Information; (iii) categories of third parties with which we disclose Personal Information; and (iv) specific pieces of Personal Information we have collected about you.
  • Not be discriminated against because you exercised any of your rights under the CCPA.
  • Opt-out of the “sale” or “sharing” (as defined in the CCPA) of your Personal Information if a business sells or shares your Personal Information (please note that we do not sell or share your personal information).
  • Limit the use and disclosure of Sensitive Personal Information where required by the CCPA (“Right to Limit”) (please note that we are not using your Sensitive Personal Information for purposes that would require that we provide you with a right to limit).

The CCPA does not restrict our ability to do certain things like comply with other laws or comply with regulatory investigations. We also reserve the right to retain, and not to delete, certain Personal Information after receipt of a Request to Delete from you, where permitted by the CCPA or another law or regulation.

How to Submit a CCPA Consumer Rights Request

If your Personal Information is subject to the CCPA, you may submit Requests to Know, Requests to Correct and Requests to Delete (“Consumer Rights Request”), you may exercise these rights by contacting us at 888-494-4881, info@pirscapital.com, or visiting our Contact page.

We are only required to respond to verifiable Consumer Rights Requests made by you or your authorized agent. When you submit a Consumer Rights Request, we may ask that you provide clarifying or identifying information to verify your request. Such information may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, your name and email address. Any information gathered as part of the verification process will be used for verification purposes only. You are permitted to designate an authorized agent to submit a Consumer Rights Request on your behalf and have that authorized agent submit the request through the provided methods. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on your behalf. We may also require that you directly verify your own identity with us and directly confirm with us that you provided the authorized agent permission to submit the request.

Shine the Light

Under California's Shine the Light Law Residents of the State of California may request a list of all third parties to which we have disclosed certain information during the preceding year for those third parties' direct marketing purposes.

“Do Not Track” (DNT)

Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (DNT) or similar feature that signals to web services that a visitor does not want to have their online activity and behavior tracked. If a web service operator elects to respond to a particular DNT signal, the web service operator may refrain from collecting certain Personal Information about the browser's user. Not all browsers offer a DNT option, and there is currently no industry consensus as to what constitutes a DNT signal.
